- Broussard v. State Farm Fire & Cas. Co. (Jones, Weiner, Clement, JJ.). Reversing JMOL entered by district court as to issue that Mississippi homeowners’ Katrina damage was covered under wind policy; vacating award of punitive damages in favor of plaintiffs; affirming that the insurer carries the burden of proving the allocation of damages among covered and uncovered perils (i.e., among wind and water damage) under Mississippi law; affirming admission of plaintiffs’ expert’s testimony; affirming denial of insurer’s motion for change of venue; remanding for new trial.
- Johnston v. Multidata Systems Int’l Corp. (King, Stewart, Prado, JJ.). Reversing district court’s finding that it had general personal jurisdiction over corporate defendant, finding that the defendant’s contacts with the forum state (Texas) were too sporadic and limited to create personal jurisdiction; remanding with instructions to dismiss for lack of personal jurisdiction.
