The following published opinions were released by the U.S. 5th Circuit Court of Appeals on April 9, 2008:
- U.S. v. Ramos-Cardenas (King, Stewart, Prado, JJ.; per curiam). Affirming convictions on drug possession charges, holding that the evidence was sufficient, that the defendants’ Sixth Amendment confrontation clause rights were not violated by the admission of post-arrest statements by a co-defendant, and that the district court did not err in responding to a jury note during jury deliberations.
- Hartford Underwriters Ins. Co. v. Foundation Health Servs. Inc. (King, DeMoss, Southwick, JJ.; opinion by DeMoss, J.). Affirming district court, holding that Mississippi law applies to question of reimbursement of attorneys’ fees, rather than Louisiana law, where additional insured subsidiary of insured Louisiana corporation operated wholly within Mississippi and the transactions at issue occurred in Mississippi.
